Article 1: Purpose
These general terms and conditions of sale (hereinafter “GTC”) aim to define the terms and conditions under which Immersion commerce sells the Onistep software (hereinafter the “Software”) to its professional and individual customers (hereinafter the “Client”). These GTC apply to the exclusion of all other conditions, except with the express written agreement of Immersion commerce.
Article 2: Order
The Client may place an order for the Software directly on the website Onistep.com or by email at the address [order email address]. The order is firm and final upon receipt of payment by Immersion commerce.
Article 3: Price and Payment
The price of the Software is the one in effect at the time of the order, as indicated on the website Onistep.com or in the order confirmation email. Prices are expressed in euros and exclude taxes. Payment is made by credit card on the website Onistep.com or by bank transfer upon request. The Client guarantees to Immersion commerce that they have the necessary authorizations to use the chosen payment method.
Article 4: Delivery
The Software is delivered by download from the website Onistep.com after receipt of payment. The Client undertakes to provide a valid email address to receive the download link. Immersion commerce cannot be held responsible for any download problems due to technical issues beyond its control.
Article 5: Right of Withdrawal
In accordance with Article L.221-18 of the Consumer Code, the Client has a period of fourteen (14) days from the receipt of the Software to exercise their right of withdrawal without having to justify reasons or pay penalties. However, the right of withdrawal does not apply if the Software has been downloaded and/or used by the Client.
Article 6: Intellectual Property
The Software is the exclusive property of Immersion commerce. The Client is granted only a right to use the Software for their own needs and in accordance with its intended purpose. The Client undertakes not to infringe Immersion commerce’s intellectual property rights and not to reproduce, modify, or exploit the Software for purposes other than those provided for in these GTC.
Article 7: Liability
Immersion commerce undertakes to provide Software that complies with the specifications indicated on the website Onistep.com. However, Immersion commerce cannot guarantee the absence of errors or malfunctions in the Software and cannot be held responsible for the direct or indirect consequences of the Client’s use of the Software.
Article 8: Confidentiality
Immersion commerce undertakes to respect the confidentiality of the Client’s personal data in accordance with the applicable regulations. The Client has the right to access, rectify, and delete their data by writing to the address contact@onistep.com.
